Windows Phone 7 Challenge - Terms & Conditions for new zealand category

  1. By entering the Windows Phone 7 Challenge ("Competition") you agree to be bound by these terms and conditions.
  2. Only persons living in New Zealand are eligible to enter. Employees and independent contractors (and each of their immediate family members) of Microsoft New Zealand Limited ("Microsoft"), its retailers, suppliers, associated companies and agencies are not eligible to enter.
  3. Microsoft is committed to complying with Government anti-corruption and ethics policies. Employees and independent contractors of the Government must adhere to anti-corruption and ethics policies applicable to them when entering the Competition or accepting any prize.
  4. The Competition starts at 00:00am on 1 October 2010 and ends at 11:59pm on 1 November 2010 ("Competition Period").
  5. To enter the Competition you must:
    • Download the Windows Phone 7 SDK from
    • Build your application for the Windows Phone 7 and capture a screencast of your application demonstrating the core functions/features of your application with relevant commentary (maximum length of 3 minutes). Your application must have a New Zealand theme, cultural aspect and relate to local services.
    • Once the screencast is created, upload it to YouTube® and tag it #nzWP7Challenge and email during the Competition Period with the following information: a link to your YouTube® video; a 200 word summary of your application; and your contact details (name, email and New Zealand contact phone number) by 1 November 2010.
    • Microsoft will judge the entries and in its sole discretion select 10 finalists who will be announced on 8 November 2010.  If you are one of the finalists, Microsoft will contact you by phone for a telephone interview.  You will also be asked to send a copy of your application (XAP file) to Microsoft for Microsoft to test on a Windows Phone 7 device.
    • Microsoft will judge the finalists' applications and select two winners on 15 November 2010.  Each winner will receive a Windows Phone 7 handset (once released and generally available in New Zealand).  Microsoft reserves the right not to select a winner if entries are judged not to be of the required standard.  Prizes are awarded on the basis set out in, and subject to, these terms and conditions.
    • In judging the application, Microsoft will take into account aspects of innovation, creativity, user experience, quality and marketplace potential.
    • You can enter as many times as you like, but each entry must be in respect of a different application.
  6. Your application must be original. You warrant to Microsoft that the application is your original work and does not breach any third party rights.
  7. Your application must not be indecent or offensive. If any cultural motifs are depicted, you must ensure that these motifs have not been copied and that their use is appropriate having regard to prevailing New Zealand cultural standards.
  8. You agree that Microsoft is not obliged to use your entry on the Windows Phone or Zune Marketplace.
  9. Entries must be received by Microsoft by the end of the Competition Period. Microsoft is not responsible for entries not received and incomplete, illegible, 'hacked' or otherwise fraudulent entries are not valid.
  10. Finalists and winners will be contacted by phone. You may not designate someone else as a finalist or winner. If you cannot be contacted within one week of being selected or are unable or unwilling to accept your prize, Microsoft may select another finalist or give the prize to an alternate winner.
  11. Prizes are not transferable or redeemable for cash. Prizes cannot be used in combination with any other prize competitions, promotions or discounts.
  12. If you accept a prize, you will be solely responsible for all applicable taxes related to accepting the prize.
  13. If for any reason an advertised prize is unavailable, Microsoft may substitute the advertised prize for another prize which has approximately the same recommended retail price (or greater).
  14. If there is a dispute as to who submitted the winning entry, the winner will be the authorised account holder of the email address used to enter the Competition.
  15. To the extent permitted by law, Microsoft, its retailers, suppliers, associated companies and agencies will not be liable to you for any direct, indirect or consequential loss or damage whatsoever, including personal injury, which is suffered as a result of, or arising from, your participation in the Competition or winning (or not winning) any prize.
  16. Microsoft is not responsible for any problems or technical malfunction of any telephone network or lines, servers or providers, or any combination thereof. Nor is it responsible for any incorrect or inaccurate information caused by any of the equipment or programming associated with or utilised in this Competition, or by any technical or human error that may occur in the course of the administration of this Competition.
  17. Microsoft may disqualify, from participating in this Competition, any person who tampers with the entry process, or submits an entry not in accordance with these terms and conditions.
  18. Microsoft's decision in relation to the winners, or any other aspect of this Competition, is final and no correspondence will be entered into.
  19. You agree to participate in publicity generated by Microsoft (or Microsoft’s marketing partners) and agree to the use of your name, photo, screencasts and images of your application for promotional purposes.
  20. Microsoft is the promoter of this Competition and may modify these terms and conditions at any time without notice. Microsoft reserves the right to cancel, suspend or change the Competition or any element of the Competition for any reason, including any cancellation, suspension or change necessitated by any event outside of Microsoft's control.
