General Terms and Conditions

  1. The Competition related to the developer survey (hereinafter referred to as "the competition") is a competition without purchase obligation organized by Microsoft nv, having its registered office at Corporate Village | Da Vincilaan 3 | 1935 Zaventem, and is subject to the conditions specified in these competition rules.
  2. The competition lasts 14 weeks, from 24/01/2012 00:00 to 30/03/2012 23:59. The winner is determined and the prize is awarded based on the terms set out hereunder. This competition will not be determined by the responses of the survey and will not harm the confidentiality of the responses of the survey. The winners are those who answered correctly the contest question and the subsidiary question or have the closest approached. In the case of an ex aequo winners will be determined by lottery. The winners of this competition will be contacted as soon as possible per mail. The prizes will be delivered after appointment on the ground floor of the address that was specified by the participant. If a prize has not been received by the winner within 3 months after the competition (beyond the control/fault of Microsoft), the winner losses his/her rights on the prize.
  3. The survey needs to be completed on 30/03/2012 at 23:59 at the latest.
  4. Only adults and VZW/ASBL's living/established in Belgium may enter the competition, with the exception of Microsoft staff members and relatives of Microsoft staff living at home. Entry to the competition implies full and unconditional acceptance of all provisions of these rules, and any decision related to the competition of Microsoft.
  5. Monitoring of the regular nature of the competition, the strict application of the rules, the indication of the winners, the awarding of the prizes and the sending or handing over of the prizes is exercised by Microsoft against whose decisions no recourse is possible.
  6. There shall be no communication/correspondence regarding the competition rules. At any time, Microsoft is able to make changes to the rules. In any case Microsoft renounces any liability - and under no circumstance can they be deemed responsible - in case of cancellation, change, interruption or postponement of the competition in case of force majeure and/or in case of circumstances beyond Microsoft's control. Microsoft cannot be held liable for possible shortcomings in the services regarding the prize of the competition. Microsoft cannot be held liable for accidents with/during one of the competition prizes, or any form of damage caused by or with one of the competition prizes.
  7. To win one of the prizes, the participant must complete the survey and answer correctly the contest question(s) as indicated above.
  8. The participant must enter fully and correctly the name of their organization and their e-mail address. Any person who has registered in this way is able to enter the competition. The winners of the competition will be notified personally on 30/05/2012 at the latest.
  9. The prize is personal and non-transferable. It cannot be exchanged in any way whatsoever, including any monetary value or other goods or services.
  10. Through their entry, the candidates to the competition explicitly agree with these rules and regulations.
  11. Microsoft is not liable for any material mistakes or the consequences thereof, including but not limited to the prizes paid by Microsoft, any defects from third parties that provide the delivery of the prize (delay, damage, strike, loss, ...), modification, interruption or termination of the competition and/or change of the prizes; any unlawful use of our systems by a third party.
  12. There will be no communication whatsoever regarding this competition during the course of the competition; entry to the competition in any other way than the internet page is not possible.
  13. Entry to the competition implies knowledge and acceptance of the characteristics and the limitations of the Internet, more specifically regarding the technical performance, the risk of breakdowns and, more generally speaking, the risks inherent to any connection and transfer via the Internet, the lack of security of certain data against possible diversions and the risks of possible viruses on the network. Microsoft can therefore under no circumstance be held liable for:
    1. transmissions via the Internet
    2. bad operation of the Internet and/or used software
    3. the consequences of viruses, bugs, anomalies, technical defects
    4. any technical, hardware and software shortcomings whatsoever.
    Microsoft cannot be held liable for direct or indirect damage following a breakdown, dysfunctions, the disqualification of participants or the termination of the competition for whatever reason. This also applies to any direct or indirect damage that might arise from a connection with his site. Every participant must take all necessary measures to protect his/her data and/or the software programs on his/her IT equipment and/or site from any infection whatsoever. The connection with the competition site and the entry to the competition fall under the full responsibility of the participants. Microsoft reserves the right in any case to extend the competition period and to postpone any announced date.
  14. By providing your details you give Microsoft your consent to use your personal details in line with the Microsoft Privacy Statement.
  15. These terms and conditions may be adjusted at any time by Microsoft. We therefore recommend you to view the terms and conditions regularly
  16. The terms and conditions of this competition are governed by Belgian law. Any disputes arising from or otherwise related to this competition are submitted to the competent court in Brussels.
